Freedom Biker Tours Commitment to Privacy


Freedom Biker Tours Incorporated and its affiliates (“Freedom Biker Tours”, “we” or “us”) is committed to maintaining the security, confidentiality and privacy of the personal information of all individuals with whom it has contact. This Privacy Policy documents Freedom Biker Tours’ on- going commitment to you, whether you are a customer, supplier, guest, visitor to our website or otherwise, and ‎has been developed in compliance with the British Columbia Personal Information Protection ‎Act (“PIPA”) and other applicable privacy legislation.‎

Freedom Biker Tours may occasionally update this Policy. When it does so, it will revise the “last ‎updated” date at the top of this Policy, and will notify you of significant change, for example, ‎by placing a notice on its website or by sending an email alert to you.‎

Scope of Policy


This Policy addresses the collection, use, and disclosure of personal information about ‎identifiable individuals by Freedom Biker Tours and by our trusted third party service providers and ‎service partners (see further information below), and does not apply to information ‎collected, used, or disclosed with respect to corporate or commercial entities. This Policy ‎does not apply to Freedom Biker Tours’ existing or prospective employees, to whom a separate Freedom Biker Tours Employee Privacy Policy applies (please contact Freedom Biker Tours’ Privacy Officer for further ‎information - contact information for the Privacy Officer is set out below).‎

Because PIPA does not impose any requirements on Freedom Biker Tours’ collection, use, or disclosure ‎of your business contact information or certain publicly available information, this Policy ‎does not apply to such information.‎

This Policy applies to the personal information collected, used or disclosed by us when you ‎visit our websites (www.freedombikertours.com and www.freedombikertours.ca) or social media pages, use an online or mobile application offered by Freedom Biker Tours, and when you participate in our surveys, contests or promotions or participate in our tours.

What information does Freedom Biker Tours collect?


As part of its business activities, Freedom Biker Tours may collect some or all the following information from ‎you, either directly or from various other sources (as noted below)‎:

  • your name, date of birth (this is relevant because, for example, you must be 21 years of age or older to participate in our tours), home address, place of residence, gender, and t-shirt size;
  • similar information about your passenger (if applicable);
  • emergency contact information for yourself and any passenger;
  • your motorcycle make, model and year;
  • any special needs, for example, food allergies or restrictions;
  • method of payment, payment details (e.g. credit card number) and identification data (e.g. drivers license information);‎
  • your home telephone number, cellular (mobile) phone number, or home ‎email address (and similar information about your passenger, if applicable);‎
  • information about products and services purchased by you in connection with Freedom Biker Tours;‎
  • information about your purchases of Freedom Biker Tours products and services;‎
  • financial information about you (such as credit or debit card information and/or banking information in connection with payments to us);‎
  • physical abilities and attributes (for example, height, weight, and experience level ) as ‎this may relate to the various activities which you may undertake when on Freedom Biker Tours (for example, motorcycle ‎riding, light hiking/walking, swimming, attendance at cultural events/locations, and similar activities) or to facilitate equipment purchases and/or rentals;
  • medical information and history as it relates to your fitness and ability to undertake ‎various activities when on Freedom Biker Tours;‎
  • language preferences, product/service preferences, membership or loyalty ‎program affiliations and related information;
  • travel and activity itineraries, significant ‎dates (e.g. birthdays, anniversaries), interests (where you have chosen to advise us of same), ‎geolocation information; and
  • video/audio recordings, photographic images, ‎contest/survey information, and similar related information

Freedom Biker Tours’ Responsibility ‎and Information Transferred Outside Canada


Freedom Biker Tours is accountable and responsible for protecting your personal information in its ‎possession or custody, and will also take steps to require a comparable level of protection ‎when the information is being processed or managed by a third party on Freedom Biker Tours’ behalf ‎‎(examples of third party service providers include: food and beverage providers, accommodation providers, Harley Davidson motorcycle rental companies, EagleRider, participating Harley Davidson dealerships or other motorcycle rental entities, cultural and other attraction providers, and similar ‎entities).

Please note that third party service providers used by Freedom Biker Tours may be located outside Canada - accordingly, your personal information held by such service providers may be accessible to law enforcement and/or regulatory authorities according to the applicable laws of such non- Canadian jurisdictions.

Freedom Biker Tours has designated a Privacy Officer to administer Freedom Biker Tours’ compliance with this ‎Policy (see below).‎

Freedom Biker Tours’ Purposes for Collecting, Using and Disclosing Personal Information


Most of your personal information will be collected directly from you (e.g. through ‎reservations, consent forms, etc.). Some of your information may be ‎collected from other sources, such as financial institutions ‎and publicly available sources, depending on Freedom Biker Tours’ relationship with you.‎

Freedom Biker Tours may collect, use, and disclose your personal information for the following ‎purposes:‎

  • authenticating your identity;‎
  • operating, maintaining, and promoting Freedom Biker Tours ‎
  • providing products and services, such as accommodation reservations, event planning ‎and facilitation, outdoor recreation and safety services, facilities, equipment, as ‎well as hotel, dining, and other similar hospitality services;‎
  • understanding your interests and needs regarding Freedom Biker Tours products and services;‎
  • providing and administering Freedom Biker Tours’ services, including organizing, promoting and ‎hosting special events such as contests, and competitions, and providing ‎instruction related to various recreational, cultural, and other similar activities;‎
  • tracking use of Freedom Biker Tours’ services and facilities;‎
  • presenting offers and marketing communications tailored to your personal preferences (as authorized by applicable law);‎
  • requesting your participation in surveys, contests, or promotions (as authorized by applicable law);‎
  • maintaining accurate and complete customer records;‎
  • processing and collecting payments and debts owed to Freedom Biker Tours;‎
  • establishing and maintaining personalized communications with customers, contractors ‎and consultants relating to Freedom Biker Tours’ various products and services, and responding ‎to inquiries and resolving any complaints;‎
  • arranging for secure and safe accommodations and related facilities;
  • protecting Freedom Biker Tours, you and others from fraud and error; ‎
  • responding to requests and inquiries from legal and regulatory authorities;‎
  • asserting or protecting Freedom Biker Tours’ legal rights or to defend our legal interests (for example, in any ‎litigation or other legal proceedings)‎;
  • providing communication and reports to your employer where applicable (for example, in connection with an employer-sponsored motorcycle tour); and
  • complying with legal requirements and acting pursuant to legal authorizations.‎

If Freedom Biker Tours wants to use your personal information for a new purpose, it will obtain your ‎consent to do so unless the new use is otherwise authorized or required by law.‎

Disclosure


Freedom Biker Tours will not disclose your personal information for purposes other than those for ‎which it was collected (as outlined above or specified at the time of collection), except with ‎your consent or as required or authorized by law.‎

Freedom Biker Tours may disclose aggregate non-identifiable information (for example, statistics regarding ‎resort or hotel usage, survey data) to trusted third party entities (such as Destination BC or similar ‎tourism entities) for general industry analysis and promotional purposes.‎

Freedom Biker Tours will never sell your personal information to third parties.‎

Consent


Freedom Biker Tours will obtain your consent to collect, use, or disclose personal information, except ‎where Freedom Biker Tours is authorized or required by law to do so without your consent. For ‎example, Freedom Biker Tours may collect, use, or disclose personal information without your ‎knowledge or consent if the information is publicly available, Freedom Biker Tours is obtaining legal ‎advice, or Freedom Biker Tours reasonably expects that obtaining consent would compromise an ‎investigation or proceeding. Other exceptions may also apply, according to applicable law.‎

Your consent can be given expressly, impliedly, or through an authorized representative such ‎as a lawyer, agent, or broker. It can also be given verbally, in writing, electronically, through ‎inaction (e.g. if Freedom Biker Tours notifies you (for example through this Policy) that it intends to ‎collect, use or disclose your personal information for specified purposes and you do not ‎object).‎

You may withdraw your consent at any time (subject to certain legal and contractual ‎restrictions) if you give Freedom Biker Tours reasonable notice in writing. After Freedom Biker Tours receives such ‎notice, it will inform you of the likely consequences of withdrawing consent, which may ‎include its inability to provide certain services to you or to continue its relationship with you.‎

If you do not wish to receive promotional or marketing material from Freedom Biker Tours, you may ‎opt out by emailing the Privacy Officer (see below) or by using the unsubscribe mechanism provided with promotional/marketing communications from Freedom Biker Tours.

Limits on Freedom Biker Tours’ Collection of Personal Information


Freedom Biker Tours will not collect personal information indiscriminately and will limit its collection of ‎your personal information to what is reasonably necessary for the purposes which have ‎been described above or at the time of collection. Freedom Biker Tours may also collect information as authorized or required by law.‎

Limits for Using, Disclosing, and Retaining Personal Information


Freedom Biker Tours will only use and disclose your personal information for the purposes which are ‎listed in this Policy, purposes identified at the time of collection, or to which you have otherwise consented, or as authorized or required ‎by law.‎

Freedom Biker Tours will keep personal information used to make a decision affecting you for at least ‎one year after using it to make the decision.‎

Freedom Biker Tours will securely destroy, erase or make anonymous any documents or other records ‎containing personal information as soon as it is reasonable to assume that: (a) the original ‎purpose is no longer being served by retention of the information, and (b) retention is no ‎longer necessary for legal or business purposes.‎

Freedom Biker Tours will take due care when destroying personal information to prevent unauthorized ‎access to such information.‎

Accuracy


Freedom Biker Tours will make a reasonable effort to ensure that personal information it is using, or ‎disclosing is accurate and complete. In most cases, Freedom Biker Tours will rely on you to ensure that your ‎information is current, complete, and accurate. Freedom Biker Tours’ correction request process may be accessed by contacting the Freedom Biker Tours Privacy Officer (see below).‎

If you demonstrate the inaccuracy or incompleteness of personal information, Freedom Biker Tours will ‎amend the information as required. If possible and appropriate, where requested, Freedom Biker Tours will send the ‎amended information to third parties to whom such information has been previously ‎disclosed.‎

If you challenge Freedom Biker Tours’ decision regarding the accuracy of your personal information and your ‎challenge is not resolved to your satisfaction, Freedom Biker Tours will annotate the personal ‎information under its control with a note that a correction was requested but not made.

Where a correction request is refused in whole or in part, Freedom Biker Tours will notify you in writing, ‎giving the reason for refusal and outlining further steps which are available to you.‎

‎Safeguarding Personal Information


Freedom Biker Tours protects the personal information in its custody or control by making reasonable ‎security arrangements to prevent unauthorized access, collection, use, disclosure, copying, ‎modification, disposal, or similar risks.‎

Note that confidentiality and security may not be assured when information is transmitted ‎through e-mail or wireless communication. If you provide us with your email address or contact information related to text ‎messaging or similar electronic means of communication, we will assume you are ‎comfortable with us using such communication mechanisms unless you expressly notify us ‎otherwise.‎

Providing Access


You have a right to access your personal information held by Freedom Biker Tours, subject to certain exceptions set out in applicable law - if you wish to access your personal information, please contact ‎the Freedom Biker Tours Privacy Officer (see below).

Upon written request and authentication of your identity, Freedom Biker Tours will provide you with ‎your personal information under its control, information about the ways in which that ‎information is being used and a description of the individuals and organizations to whom ‎such information has been disclosed.‎

Freedom Biker Tours will respond with the requested personal information within 30 days or will provide ‎written notice where additional time is required to fulfil the request. Freedom Biker Tours will inform you ‎in advance of the cost to provide your information.‎

In some situations, Freedom Biker Tours may not be able to provide you with access to certain ‎personal information. This may be the case where, for example, disclosure would reveal ‎personal information about another individual, the personal information is protected by ‎solicitor-client privilege, the information was collected for the purpose of an investigation or ‎where disclosure of the information would reveal confidential commercial information that, if ‎disclosed, could harm Freedom Biker Tours’ competitive position. Freedom Biker Tours may also be prevented by ‎law from providing access to certain personal information.‎

Where an access request is refused in whole or in part, Freedom Biker Tours will notify you in writing, ‎giving the reason for refusal and outlining further steps which are available to you.‎
